On August 23, 2026, Law No. 195\/2024 \u201cOn the Protection of Personal Data\u201d will come into force in Moldova.<\/strong> The new law introduces rules harmonized with the European approach to personal data protection and significantly changes the requirements for their processing, including on websites.<\/p>\n\n

For website owners, the technical part is especially important.<\/p>\n\n

What needs to be changed on the website and why is it important?<\/strong><\/h2>\n\n

The website must review all methods by which user data is collected and processed. This primarily applies to Google Analytics, Meta Pixel, Hotjar, and other analytics and advertising tools<\/strong> : non-essential scripts should not be run without the user’s consent. A cookie banner alone is not sufficient \u2013 \u200b\u200bthe website must technically honor the user’s choice and store information about the consent provided, including the date, text version, and selected categories. <\/p>\n\n

It’s also necessary to review feedback, registration, order, and other forms<\/strong> where personal data is collected. If consent is required for processing, it must be provided by the user separately and consciously: the checkbox should not be pre-selected. <\/p>\n\n

Why is this important?<\/strong> Because once the law comes into force, simply having a privacy policy or a cookie banner on a website isn’t enough. A proper consent process must be ensured at a technical level. If a website continues to collect data before consent is granted or doesn’t allow confirmation of when and what the user has consented to, this could lead to non-compliance with the new requirements and pose risks for the website owner. <\/p>\n\n

Check your website yourself<\/strong><\/h2>\n\n

To avoid penalties from regulatory authorities, check your website right now using these short instructions:<\/p>\n\n

  1. Open the website in incognito mode<\/strong> and don’t click the “Consent” banner. Press F12 \u2192 Network. If you see requests to Google Analytics, facebook.net, Hotjar, and other services, your consent hasn’t been granted yet, but data may already be being collected. <\/li>\n\n\n\n
  2. Does the banner have a “Reject” button and is it the same size as the “Accept” button?<\/strong> If only an “Accept” button is offered, it is not a full user choice.<\/li>\n\n\n\n
  3. Check the forms:<\/strong> the consent checkbox must be separate and NOT pre-checked.<\/li>\n\n\n\n
  4. Check where consent information is stored:<\/strong> who consented, when, and to what? If this information is not stored anywhere, it will be impossible to prove consent. <\/li>\n\n\n\n
  5. Check your privacy policy:<\/strong> does it specify real data retention periods and specific recipients of the data, rather than template wording copied from another website?<\/li>\n<\/ol>\n\n
